🚨 BREAKING: SDRCC Sets Aside Arbitrator’s Ruling in Nikolaj Sørensen Case
The panel says the earlier ruling can’t stand and sends key issues back for further review.
The Sport Dispute Resolution Centre of Canada (SDRCC) has issued a short decision in the case involving Nikolaj Sørensen, finding that the earlier arbitrator’s ruling was not reasonable and must be set aside.
In the decision, the SDRCC panel ruled that the arbitrator made errors of law that could not be justified based on the facts that were before the Safeguarding Appeal Tribunal.
As a result, the panel has not issued a final outcome on the merits of the case. Instead, it has ordered additional submissions from the parties on two key issues.
First, whether the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (UCCMS) applies to the alleged conduct, and whether Abuse-Free Sport has jurisdiction in this case.
Second, whether the Director of Sanctions and Outcomes’ original finding of a UCCMS violation, and the corresponding sanction, should be reinstated while those jurisdictional questions are resolved — or if the matter should be sent back for further review.
The panel has directed the parties to agree on a procedural schedule for those submissions.
